Yashica’s comeback camera hit by claims of delays and poor quality

The Kickstarter campaign for Yashica’s digitFilm Y35 camera has produced a wave of complaints about delays in shipping product as well as cameras that don’t work. Running with the foreshadowing strapline ‘Expect the Unexpected,’ the campaign seems to be delivering on its promise to be unexpected by giving some of the 6935 backers exactly what they weren’t hoping for.

The campaign raised HK $ 10,035,296 (approx. $ 1,280,225) for the firm and promised a digital camera that you load with different ‘film cassettes’ that apply specific styles to the pictures. While a delivery date of April 2018 was given at the time of the launch many backers have yet to receive their cameras.

In the last update, on 18th September, the company explained that they are dealing with 38 different combinations of product, and that they were working hard to get orders completed by the end of the month. However, four weeks later the feedback section is 3900 comments long, and while some are complaining that their camera hasn’t arrived others say the shutter button doesn’t work or that the camera switches off unexpectedly.

One user who has received his camera tells those who haven’t to stop complaining, as the product is so bad they’ll be happier now than when it arrives.

The picture isn’t much brighter on Indiegogo where the project took the total raised to $ 1,515,695, as more investors are making the same complaints. The principle problem seems to be the lack of communication from the manufacturer that’s leaving customers in the dark about their cameras and their money.

This hasn’t been a good period for camera-related campaigns on crowd-funding sites, as this failure comes right after the collapse of Meyer Optik Gorlitz, and its associated brands, which left many photographers out of pocket and without the costly products they had backed.

Lawsuit claims Apple’s dual-camera setup in recent iPhones infringes on 2003 patent

A lawsuit filed with the U.S. District Court for the Northern District of California on Tuesday claims the cameras in Apple’s iPhone 7 Plus and newer dual-camera models infringe on a patent that was granted in 2003 and is based on an invention from 1999.

Plaintiffs Yanbin Yu and Zhongxuan Zhang allege Apple’s dual-cameras are in infringement of U.S. Patent No. 6,611,289 for “Digital cameras using multiple sensors with multiple lenses”.

The patent describes methods for capturing multiple images using multiple lens and sensor arrays. The patent focuses on a four-camera setup that captures images on monochrome sensors and merges them into a single color image. According to the lawsuit Apple was aware of the existing patent as early as 2011.

The complaint also alleges that Apple’s own multi-sensor camera patent No. 8,115,825, “Electronic device with two image sensors.” which was filed for in 2008 and granted in 2012, claimed “many of the same features” as the patent from Yu and Zhang.

The plaintiffs note that Apple made significant investments into its dual-camera technology, acquiring 3D sensor specialist PrimeSense in 2013 and camera technology company LinX Imaging in 2015 but did not seek to license Yu and Zhang’s patent, launching several iPhone models knowing they were infringing on somebody else’s patent.

This is not the first time Apple has camera-related legal problems. Earlier this year Israel-based company CorePhotonics also files a lawsuit against the US company. We’ll continue to keep an eye on both cases.

Instagram leak claims post re-sharing feature is in testing

A new report from The Verge claims Instagram is currently testing a feature that allows users to re-share posts to their own account feeds. Such a feature, assuming it were to launch publicly, would allow Instagram users to share other users’ content, each re-shared post reportedly showing the original poster, as well as each user that subsequently shared it.

The Verge cites screenshots of the alleged test and “an interview with a source,” in its report, however Instagram told the publication that it is not developing or testing a re-sharing feature.

A re-sharing tool, if one launches, may be limited to businesses

Nonetheless, the report claims that Instagram is calling the feature “seamless sharing” internally, developing it as a way for users to present photos and videos from other users in their own feeds. This would be similar to the Stories sharing feature Instagram launched earlier this year. Each post can reportedly be shared at least two times, the reports states.

The feature pictured within the leaked screenshots is described as “extremely rough,” indicating that development is still in its early stages. As with any test, it’s possible no such feature will be launched publicly to users. The report also points out that a re-sharing tool, if one launches, may be limited to businesses as a way for users to share merchandise posts with their followers.

Sony claims top spot in full-frame interchangeable lens camera market, launches ‘Be Alpha’ campaign

In a press release issued this morning, Sony announced it has sold more full-frame cameras than any other brand in the US over the past six months, measured both by units sold and by value.

Perhaps more impressively, the company is also celebrating occupying the top position in the overall mirrorless market, a spot it has owned for the past six years thanks to the huge success of the a6000, as well as sales of the a7 series.

That’s all good news for Sony, yes, but it’s probably no coincidence that Sony was the last brand to release a mass-market full frame camera. It’s been a year since Canon’s last entry in the category, and a similar amount of time since Nikon announced the D850. And either way, we don’t recommend getting too invested in brand market share, but that’s just us.

Sony’s also taking the opportunity to launch a brand new ‘Be Alpha’ campaign, which will comprise a number of in-person events in major cities, starting on August 19th in New York City to celebrate World Photography Day. The initiative also includes an ‘Alpha Female’ program, which will include grants, mentorship and events to address “the imaging industry’s well-documented diversity challenges.”


Sony Celebrates No.1 Overall Position in U.S. Full-frame Cameras with Launch of Historic “Be Alpha” Campaign

SAN DIEGO, Aug. 15, 2018 – Sony Electronics, Inc. – a worldwide leader in digital imaging and the world’s largest image sensor manufacturer – today announced that it has overtaken and held the No. 1 overall position in the United States full-frame interchangeable lens camera market in the first half of 2018, in both dollars and units1. Monkey copyright lawsuit finally over, court rejects PETA’s claims

PETA’s “monkey selfie” copyright lawsuit has finally, finally reached a satisfying ending. On Monday, a three-judge panel with the Ninth Circuit Court of Appeals ruled that only humans can pursue copyright infringement claims, upholding a lower court’s decision after a judge refused to let PETA settle its way out of this likely conclusion.

In its ruling, the court said:

Affirming the district court’s dismissal of claims brought by a monkey, the panel held that the animal had constitutional standing but lacked statutory standing to claim copyright infringement of photographs known as the “MonkeySelfies.” … The panel held that the monkey lacked statutory standing because the Copyright Act does not expressly authorize animals to file copyright infringement suits.

The ruling follows the Ninth Circuit’s decision earlier this month to reject PETA’s settlement dismissal request.

PETA had argued that the macaque named Naruto, not camera owner David Slater, owned the copyright because it took the image itself. Courts had expressed skepticism about PETA’s argument, also questioning whether the organization had a suitable relationship with the monkey to sue on its behalf.

In September 2017, PETA announced a settlement with Slater; it asked the Ninth Circuit Court to dismiss the case and vacate the lower court’s ruling. However, in a decision earlier this month, the Ninth Circuit indicated that it had rejected the request because it seemed to be PETA’s way to avoid establishing a precedent. The court had also stated:

As one of our colleagues once warned in a similar context, “courts must be particularly wary of abetting ‘strategic behavior’ on the part of institutional litigants whose continuing interest in the development in the law may transcend their immediate interest in the outcome of a particular case.”

The ruling doesn’t impact PETA’s settlement with Slater, which requires the photographer to donate 25% of future revenue from the image to charities that protect crested macaques in Indonesia.

Leaked government memo claims DJI is spying on the US for China

Drone maker DJI’s security troubles continue to grow, as a newly leaked U.S. Immigration and Customs Enforcement (ICE) memo claims the company may be spying on the US on behalf of the Chinese government. Per the memo, DJI drones and mobile apps are possibly being used to gather data on critical US infrastructure, law enforcement, and more.

The ICE memo was issued on August 9, 2017, and is unclassified. In it, the memo claims that DJI is “likely” providing the aforementioned data to the Chinese government, an assertion that is “based on information derived from open source reporting and a reliable source within the unmanned aerial systems (UAS) industry with first and secondhand access.”

The claims aren’t a certainty, according to ICE, which says in the memo that Special Agent in Charge Intelligence Program (SIP) Los Angeles has “moderate confidence” that DJI is providing law enforcement and critical infrastructure data to China. However, the memo claims that SIP LA has “high confidence” that DJI is “selectively targeting government and privately owned entities within these sectors to expand its ability to collect and exploit sensitive U.S. data.”

SIP Los Angeles makes some alarming claims about the DJI GO and SkyPixel mobile apps, saying in part that they grab facial recognition data even if the feature is disabled. The collected data, which is said to include sensitive personal info like full names, images and videos, phone numbers, and computer credentials, are automatically uploaded to unspecified “cloud storage systems” in Hong Kong and Taiwan “to which the Chinese government most likely has access.”

The memo goes on to state that SIP LA has “high confidence [that] a foreign government with access to this information could easily coordinate physical or cyber attacks against critical sites.”

Sources of information (SOI) have informed officials, according to the document, that:

The Chinese government is using DJI UAS as an inexpensive, hard-to-trace method to collect on U.S. critical assets … directorates most likely receiving the data from DJI’s cloud are the offices responsible for defense, critical infrastructure, traffic controlling, and cyber offense…

This isn’t the first time DJI has been the source of security concerns. Earlier this year, the U.S. Army issued a memo, as pointed out in this most recently leaked document, that ordered its units to immediately cease use of DJI products over security concerns. Additionally, security researcher Kevin Finisterre recently claimed that DJI threatened him after he submitted a bug bounty report highlighting serious security issues he had discovered with the company’s system.

For its part, DJI has released an official statement on the leaked ICE memo, saying:

The bulletin is based on clearly false and misleading claims from an unidentified source. Through the law firm of McDermott Will & Emery, DJI provided ICE a detailed rebuttal of the report, explaining why the data behind its conclusions is deeply flawed.

As DJI explained to ICE, the allegations in the bulletin are so profoundly wrong as a factual matter that ICE should consider withdrawing it, or at least correcting its unsupportable assertions. DJI further urged ICE to consider whether the source of the allegations may have had a competitive or improper motive to interfere with DJI’s legitimate business by making false allegations about DJI.

The company states that some of the claims in the ICE memo can be “easily disproven,” including with “a simple internet search,” while other claims are said to be “unsupported by facts or technical analysis.”

That said, the ICE memo claims, “Much of the information collected [by DJI products] includes proprietary and sensitive critical infrastructure data, such as detailed imagery of power control panels, security measures for critical infrastructure sites, or materials used in bridge construction.”

DJI is allegedly “focused on targeting” the utility companies that provide drinking water in four big locations: New York, Los Angeles, Chicago, and New Jersey. The memo claims the drone maker is also focused on railway companies located in Los Angeles, Dallas-Fort Worth, and Omaha, the Milan Army Ammunition Plant in Fort Riley, Kansas, and it is allegedly also providing the Chinese government with data to help it determine which assets to acquire in the U.S.

Congress is considering a copyright small claims bill you should know about

A bill has reached Congress that aims to establish a cheaper route for those seeking settlement of small claims in copyright infringement cases. Put forward by a bypartisan group of representatives, the Copyright Alternative in Small Claims Enforcement Act of 2017 (CASE) intends to provide a more viable alternative to federal courts for those making relatively small claims in cases where the cost of pursuing compensation deters individual photographers and small to medium sized business owners.

The current system can cost professional photographers wishing to file a claim for unauthorized use of an image almost a year’s earnings, according to a report by Copyright Defence, and copyright lawyers are unwilling to take on a case in which damages would be less than $ 30,000.

Copyright Defence says that the average claim made by photographers is $ 3,000 or less, making the pursuit of offenders impractical and letting infringers off scot-free.

The new bill proposes that a small-claims style panel be set up within the Copyright office that would allow these low-value, high-volume disputes to be heard. Such an introduction would benefit not only photographers and artists, but also musicians, film makers and anyone who produces creative work.

Bought to Congress by Hakeem Jeffries of the Democrat Party and Tom Marino, a Republican, the bill is supported by the American Society of Media Photographers, American Photographic Artists, National Press Photographers Association, Professional Photographers of America, North American Nature Photography Association, among others. The bill was first proposed by a collection of visual artists groups in February 2016.

Reps. Jeffries, Marino Lead Bipartisan Effort to Help Musicians and Artists Protect Their Creative Work

WASHINGTON, DC – A bipartisan solution to help artists, photographers, filmmakers, musicians, songwriters, authors and other creators protect their life’s work from unauthorized reproduction has been introduced today by two key members of the House Judiciary Committee — U.S. Representative Hakeem Jeffries (NY-08), a Democrat, and U.S. Representative Tom Marino (PA-10), a Republican.

The Copyright Alternative in Small-Claims Enforcement (CASE) Act of 2017 will create a Copyright Claims Board (“CCB”) in order to provide a simple, quick and less expensive forum for copyright owners to enforce their intellectual property. The majority of the copyright owners that are affected by piracy and theft are independent creators with small copyright infringement claims. The CCB will establish an alternative forum to the Federal District Court for copyright owners to protect their work from infringement.
A broad coalition of legislators have co-sponsored the bill, including Democratic Congresswoman Judy Chu (CA-33), Republican Congressman Doug Collins (GA-9), Democratic Congressman Ted Lieu (CA-33) and Republican Congressman Lamar Smith (TX-21).

Rep. Jeffries said: “The establishment of the Copyright Claims Board is critical for the creative middle class who deserve to benefit from the fruits of their labor. Copyright enforcement is essential to ensure that these artists, writers, musicians and other creators are able to commercialize their creative work in order to earn a livelihood. The CASE Act will enable creators to enforce copyright protected content in a fair, timely and affordable manner. This legislation is a strong step in the right direction.”

Representative Marino said: “Creators, solo entrepreneurs, photographers, and artists often struggle to enforce their copyright in a timely and cost efficient manner. This can hinder creativity and prevent these professionals from being able to sustain a profitable livelihood. The CASE Act provides a boost to copyright holders and allows a forum for timely resolutions. This is a positive step in the right direction.”

Representative Collins said: “America’s economic leadership depends on its commitment to protecting intellectual property, and I’m proud to work with my friend Congressman Hakeem Jeffries to provide another tool to make this possible. A copyright small claims system would offer small creators a simple, effective forum for defending their property rights against infringement. The Copyright Alternative in Small-Claims Enforcement Act offers creators an efficient and cost-effective process to protect their creations. Representative Chu said: “Creators like artists, photographers, and songwriters contribute over a trillion dollars to our economy each year. But intellectual property theft makes it difficult for creators to earn a living. This is especially true for small and individual creators who depend on licensing and copyright, but lack the resources to adequately challenge copyright infringement claims in federal court. I’m proud to support the CASE Act because it proposes a common sense solution that will make it easier for creators to protect their intellectual property and continue to share their works and grow our economy.”

Participation in the CCB will be voluntary, and respondents will have the ability to opt out. The CCB will be housed within the U.S. Copyright Office, and its jurisdiction limited to civil copyright cases with a cap of $ 30,000 in damages. A panel of three Copyright Claims Officers will be designated to adjudicate and settle copyright claims. The simplified proceedings do not require the parties to appear in-person and will permit them to proceed pro se – i.e., without an attorney.

The bill is supported by the Authors Guild, American Society of Media Photographers, American Photographic Artists, National Press Photographers Association, Professional Photographers of America, North American Nature Photography Association, Songwriters Guild of America, Nashville Songwriters Association International, National Music Publishers Association, Digital Media Licensing Association, Graphic Artists Guild, Creative Future, and the Copyright Alliance.

Andy Warhol estate preemptively sues photographer over infringement claims

Photographer Lynn Goldsmith has been sued by The Andy Warhol Foundation following her alleged claims that the artist infringed upon a photo she took of musician Prince in 1981. The lawsuit appears to be a preemptive strike against Goldsmith; it argues that Warhol merely ‘drew inspiration’ from the photo to create an entirely new – and therefore infringement-free – image.

At the heart of the issue is a 1981 publicity photo of Prince taken by Goldsmith, who has allegedly raised issues with the artist’s estate over claims that Warhol’s ‘The Prince Series’ artwork infringes her copyright. The lawsuit seeks to establish that the artist’s work (made in 1984) is a new creation, thereby preventing any future potential lawsuits brought by the photographer against Warhol’s estate.

The lawsuit highlights elements of Warhol’s work that deviate from Goldsmith’s photograph, including, ‘substantially heavier makeup’ around the eyes, as well as a different angle of the head. According to The Wrap, Warhol’s estate is seeking a declaratory judgement stating both that the statute of limitations has run out on any possible infringement claims by Goldsmith, and likewise that the artist’s work does not violate the photographer’s copyright.

Lily Robotics sued over claims of false advertising

Yesterday Lily Robotics, the company behind the waterproof subject-tracking Lily Drone, announced that it was ceasing operation after failing to secure necessary funding, despite $ 34m worth of pre-orders. Now it looks like there’s more to that story: the company has been sued by the San Francisco district attorney’s office over claims of false advertising and unfair business practices.

After a lengthy investigation the attorney’s office alleged that the promotional video, which was used during the initial crowdfunding campaign for the Lily Drone, had not been shot with an actual prototype of the device but a “much more expensive, professional camera drone that requires two people to operate.”

“It does not matter if a company is established or if it is a startup,” District Attorney George Gascón said on Thursday. “Everyone in the market must follow the rules. By protecting consumers, we protect confidence in our system of commerce.”

On its website and in a letter to pre-order customers, Lily Robotics promised it would be issuing refunds to customers over the next 60 days but now the attorney’s office has also obtained an order from a judge requiring the company to return all the money it received from customers and not use it for other purposes. Lily had received approximately 60,000 pre-orders at between $ 499 and $ 899 each.

Nikon introduces D3400 with SnapBridge, big battery life claims

Nikon has announced the D3400, updating its most beginner-friendly entry-level DSLR. The D3400 is physically smaller than its D3300 predecessor, but continues to offer many of the same specifications including a 24MP APS-C CMOS sensor with no optical low-pass filter. Nikon says the battery is rated to 1200 shots per charge, which is a serious boost compared to the D3300’s already respectable 700 shots per charge.

SnapBridge is a new addition to this line, enabling connectivity with a mobile device over Bluetooth Low Energy (BLE) – though no Wi-Fi connectivity is offered. The D3400 offers an EXPEED 4 processor, 11-point AF system, 1080/60p video, 5 fps burst shooting and a 3″ 921k-dot LCD, all consistent with its predecessor.
