‘Gear Lust’ music video is a photographer’s ode to Gear Acquisition Syndrome

Canadian photographers Taylor Jackson and Lindsay Coulter teamed up to create ‘Gear Lust,’ a music video centered around Gear Acquisition Syndrome — that is, a photographer’s compulsion to acquire more gear than can reasonably be used.

The amusing song kicks off with, ‘Some people say that I have a problem acquiring gear, some say that I have Gear Aquisition Syndrome, but I like to call it Gear Lust.’

In addition to YouTube, the song is available to stream from Spotify and Apple Music.

Judge rules RNC didn’t violate photographer’s copyright with unauthorized image use

In May 2017, photographer Erika Peterman filed a copyright infringement lawsuit against the Republican National Committee (RNC), alleging the organization had used one of her images for a political mailer without permission. The image features Rob Quist, a Democratic congressional candidate who had run against GOP candidate Greg Gianforte in Montana.

Peterman’s image, which was licensed to the Quist campaign, was used by the RNC without permission as part of a mailer that mocked the politician. In response to the lawsuit, the RNC claimed its mailer represented fair use of the copyrighted image, and Montana judge Dana L. Christensen has sided with that argument.

According to Lexology, the court dismissed Peterman’s case, finding that the RNC had ‘transformed’ the photo adequately enough to claim fair use. Only small visual alterations were made to the image, such as cropping it to fit the mailer, and those edits alone weren’t sufficient for it to be considered transformative.

However, the court found that the image’s use on a mailer that criticized Quist had transformed the work, stating that the image’s inclusion as an element in this critical media qualified as fair use. The court said:

The mailer uses Quist’s musicianship to criticize his candidacy, subverting the purpose and function of the Work. With the addition of the treble clefs and text throughout, the mailer attempts to create an association between Quist’s musical background and liberal political views… In this context, the image takes on a new meaning.

In addition, the court claimed that the RNC’s use hadn’t impacted Peterman’s ability to profit from the image and that Peterman’s had published the image to Twitter and Facebook. By publishing the image on social media, the court stated, ‘it must be assumed that the MDP, Quist Campaign, and Peterman herself would have welcomed reposts, [etc.] by other pro-Quist social media users.’

Ultimately, the federal judge found the RNC’s unauthorized use of the copyrighted image to be ‘moderately transformative and wholly noncommercial [sic],’ stating that ‘the court determines that the undisputed facts establish that the RNC is entitled to judgement as a matter of law.”

DPReview spoke with Peterman via email and she shared the following response regarding the ruling:

I think equating political criticism to transformative use is pretty far-reaching. This decision gives any political party (or PAC) the freedom to use artistic or creative photos of political candidates for political criticism under the auspices of fair use. This impacts me greatly because I do a lot of political photography and work hard to create compelling, creative photos for the candidates I work with. And, like any photographer or artist, I also want to share my work. However, if I know that my photos can be used for “political criticism” without my permission, it creates a major dilemma for me.
And no, I’m not appealing. Not because I don’t think the decision is wrong, because I do. However, even if my decision were reversed and remanded back to the district court for a trial on whether the RNC’s use of my photo was “transformative”, I would again be in front of the same judge and the outcome would probably be the same. Additionally, I would most likely have to pay the RNC’s costs and possibly their attorney fees. That’s thousands and potentially hundreds of thousands of dollars I don’t have.
Last, the judge’s comments about my sharing the photo on Twitter are incorrect. I posted a different photo of Rob Quist on Twitter, but not the one that was the subject of the lawsuit.

DPReview has contact both the RNC and Peterman for comment. this article will be updated accordingly when and if a response is given.

Widen your window: a message to landscape photographers

If there’s one thing landscape photographers obsess over more than gear, it’s light. And often, we fall into the trap of treating light as a zero-sum game – either a sunset is amazing or it’s a complete fizzer. This all-or-nothing mindset is detrimental to our growth as photographers and the work we can produce.

Instead, when we approach our time in the field with a richer appreciation for the subtle, ever-changing interplay between light and landscape, we foster greater opportunities for creative expression.

Expectations create limitations

Early in my landscape photography journey, I would fixate on burning sunrises and sunsets. Almost obsessively, I would track the clouds each day, searching for the signs of a promising explosion of color. While every month or two the heavens would align, more often than not, the sky either fizzled out or failed to produce the color I had hoped for.

By tying our time in the field to ‘great light’, we limit our opportunities

Chasing idealized visions of light, I’d either a) go out anticipating perfect conditions, only to be disheartened when it didn’t materialize, or b) I wouldn’t go out at all if there weren’t signs of a banger on the way. I’m not sure which was worse. Both mindsets have been harmful to my development as a photographer. In hindsight, internalizing the concept of ‘perfect light’ falling across each scene was an unrealistic expectation—one that set me up for disappointment and hampered the images I took.

By tying our time in the field to ‘great light’, we limit our opportunities. Opportunities to grow in versatility. Opportunities to better experience landscapes and compose scenes. Opportunities to expand, refine and execute on our photographic vision.

Go out earlier, stay out later

If you’re the kind of person who, like I was, predominantly shoots 20 minutes either side of sunset (or sunrise), then consider widening your capture window. That is, arrive on location an hour earlier, and continue taking images well into twilight.

This enables you to gain a more rounded understanding of the key elements of the scenes unfolding before you. Exploring locations without looming time pressures offers you the freedom to discover compelling compositions. Compositions that may not present themselves to others who simply arrive at the car park 10 minutes before sunset.

Time is a limited resource, particularly so for some more than others

(Note: This emphasis on time is understandably more difficult for people traveling or working another full-time job—people like me. Time is a limited resource, particularly so for some more than others. If that’s you, then reflect on your priorities. Do you want to capture a collection of good images from multiple locations? Or is your preference for a handful of great images—images that you’d be proud to add to your portfolio?)

Additionally, expanding your capture window forces you to experience the landscape under ever-changing lighting conditions. Over a one hour period on sunset, a scene can change from golden side light, to indirect light from colorful clouds overhead, to soft, yet moody, blue light before dusk arrives. Sometimes a burning sky can be too overwhelming, commanding all the attention in an image, while softer light during twilight may better emphasize the mid-ground and foreground elements.

Challenge yourself

By allowing yourself more time, you can still reserve a window for your ideal composition later in the shoot. Having that composition safely scheduled away opens up new opportunities to create images you not only previously overlooked, but may have entirely not thought possible.

Furthermore, this mindset needn’t – and shouldn’t – apply to sunrise/sunset scenes. Challenge yourself to head out during non-ideal conditions. When time allows, explore landscapes in the middle of the day, after (or for those more adventurous, during) rain or even under moonlight.

Without a colorful sky acting as a crutch to make the scene interesting, how else might you compose it make it compelling? For seascapes, try shooting handheld and getting even closer to the action. For forest scenes, consider shooting with a telephoto lens to really focus in on the subject and remove all distractions. While it’s approaching cliche, experiment by adding a human element to your image for an enhanced sense of scale and place. And when all else fails, shoot abstract – capture intimate details that hone in on key elements of the landscape.

Final thoughts

This article shouldn’t be treated as a prescriptive guide – nor would I want it to be. Each of us has our unique way of seeing and capturing the world around us. That’s one of the reasons so many landscape photographers are passionate about their craft. It’s a medium for personal expression.

Rather, I’m sharing this article to encourage you to expand the scope of your photography and of your potential as an artist. To broaden your view of the images you can (and hopefully will want) to create. To open up new possibilities for your creative vision.

Hands on: Synology DS1019+ is a five-drive NAS storage solution for photographers

Synology DS1019+ NAS hands on

Network attached storage manufacturer Synology recently announced a new DiskStation model that aims to provide a lower price-point 5-bay NAS for photographers and small businesses. The DS1019+ will sit below the DS1517+ and offers a more restricted set of options for reduced cost, but without killing the speed and functionality associated with the brand.

The device offers a maximum capacity of 60TB when each of the five bays are loaded with a 12TB drive, which is the same level of storage that can be achieved with the top end model. But the DS1019+ has only two LAN ports, limiting expansion – the more expensive DS1517+ NAS has four. The DS1019+ also doesn’t offer an upgradable LAN connection and has less flexibility when it comes to the functions of its RAM. It does, however, provide a fast processor and the same set of software packages that are common to most Synology products. It can also transcode and stream two channels of H.264/H.265 4K video at the same time to your TV, tablet or phone.

We got hold of a unit to take a closer look at the NAS itself, how easy it is to set-up and the applications that can be installed on it.

Twin fans cool the five drives, LAN provides expansion

Twin fans keep the five drives cool, and ensure the quad-core 1.5GHz J3455 processor doesn’t over-heat. The DS1019+ comes with 4GB of RAM built in, but that can be expanded to 8GB via the dual M.2 slots hidden in the base, with the extra RAM being used for cacheing.

The rear also reveals two 1GBE LAN ports – these can be used to connect a single Expansion Unit DX517 for additional storage. Maximum storage capacity when the DS1019+ is linked to a DX517 is 120TB. With 1GbE LAN you can expect read/write speeds of up to 225MB/s even with AES-NI encryption.

Accepts 3.5-inch or 2.5-inch SATA HDD/SSD drives

The Synology DS1019+ can accept five 3.5-inch or 2.5inch SATA HDD/SSD drives, which sit in these trays to be mounted into the NAS. The tray is well made, and although lightweight it feels solid enough to hold and protect the drive. The base is open for ventilation, and the front face is hinged to provide a handle for removing it from the enclosure.

Drives are secured in trays

I used 6TB Seagate Ironwolf drives and filled four of the bays. The drives slot in to the trays nicely, and a pair of plastic rails with protruding pins secure them into place. Securing all four of the disks was a two-minute job and about as straightforward as it is possible to be. A set of screws comes with the kit for fixing 2.5-in drives to the trays.

To swap drives, simply slide in and out

The loaded trays slot back into the enclosure along runners that make it very difficult to do it wrong or to misalign on entry. Once in place and pushed in as far the tray will go, the protruding handle can be pushed in flush with the rest of the unit.

Plastic keys lock drive bays closed

A pair of plastic keys comes with the NAS that allow the bays to be locked. It would be pretty difficult to open one by accident and to pull out the drive, but it’s better to be safe rather than sorry. Provided you’re using a RAID configuration, drives can be switched out should they fail or if you want to increase the size of your storage capacity later.

Status lights indicate which drives are in use, failure

With the DS1019+ plugged in, the drives come to life, and lights on the enclosure illuminate to let you know they are in action. It is then ready to use. The lights let you know when each drive is in use, and also when one has failed. The lights stay green when the drives are at the normal temperature, and go orange when they are too hot.

Router setup is simple

With the DS1019+ powered up, and connected to a router, it is only a matter of seconds before it becomes available to set up on the computer. Synology’s Assistant detects the NAS and when you select it, the management software can be started up.

Disk Station Manager guides setup

Disk Station Manager makes it pretty easy to get the NAS ready to use. The applications take us through the setup step-by-step and explain what the options are at each stage. Most of the language is straightforward, but when it isn’t, the company’s online Knowledge Base does a good job of supporting you through with a mixture of text and video guidance.

Drives can easily be configured

When you come to create a storage pool you need to choose what RAID type you want the NAS to use. The DS1019+ allows RAID 0, Basic, JBOD, 1, 5, 6 and 10. RAID 10 can only be used if there are four or more drives in the pool. The drop down interface allows you to select the type while the information panel clearly explains the properties of that type of RAID, with the pros and cons of each. Even if you don’t think you know what you are doing this interface takes most of the mystery out of the set-up.

Using RAID can feel a bit painful, as it seems we only get to use a part of the storage capacity we have bought. The idea of using a RAID system is that the drives effectively back each other up by the degrees that we choose. RAID 0 doesn’t provide any backup so the full capacity of the drives is available as storage, but if a drive fails we lose the data that was stored on it.

RAID 10, on the other hand, effectively saves each element of data twice across the drives, so that if one fails whatever was on it will be duplicated somewhere on the other drives. This makes your data safe, but the downside is that it halves the amount of space we have to use. With my four 6TB drives in this test I can only save just under 11TB of data to the NAS when it is set up for RAID 10 – less than half of the potential 24TB I paid for. If I used RAID 0 however, I would be able to save close to 23TB on the same drives – but it would be insecure.

Create a network folder to access content of drives

You can access the contents of the NAS by creating a network folder in Explorer or Finder, or through a web browser using the DiskStation interface via the network address of the NAS. A QuickConnect link can be dropped onto the desktop too that takes you straight there without having to type into the browser search bar.

Useful suite of applications included

While the storage capacity is the obvious concern with any NAS, how you can use that space is also very important. Synology offers a suite of applications that allow the space to be tailored in order for it to be more than just a data bank that can be accessed via your home network. Critically for photographers DS Photo, DS Video and media streaming facilities make organising, accessing and sharing images and movies very easy and convenient wherever you are – provided you have an internet connection.

One of the key elements of the Synology system is the choice of apps, or packages, available to help get the most from the device. Typing ‘Media’ into the search bar shows all the packages that will be relevant to photographers.

Photo Station 6 to create photo albums

Photo Station will be the main package for stills workers as it offers a way to create albums of images saved on the NAS that can be viewed both from your desktop computer and via the DS Photo smart phone app. Both desktop and phone based applications let you organize your images as well as to share them directly to social media or to send links to other people. You can create a private album for a client and send a link for them to view and/or download the contents.

The same features are provided for videographers via Video Station, so you can stream content to a TV or your phone when you want to show a project. Of course you can host your website on the NAS too, via Web Station and email servers can be created – as well as the usual timed data back-up services you’d expect.

Kodak’s photo service KodakIt criticized for stripping photographers of copyrights

Renewed controversy surrounds Eastman Kodak subsidiary KodakIt, a service launched in 2017 as a way to provide businesses with on-demand access to photographers around the globe. The service was criticized in its early days for offering very low payments, but a new report from PDN highlights another problem: it requires photographers to completely surrender their copyrights.

A report from PDN digs into KodakIt’s ‘Photographer Terms and Conditions,’ noting that it requires its photographers to ‘perpetually and irrevocably’ hand over their copyright to the client who purchased the work — in fact, it specifies ‘the entire copyright’ and all rights associated with it.

Photographers are required to get permission from KodakIt and the client before using any images — including outtakes — for personal promotion. As well, the ‘Photographer Terms and Conditions’ requires KodakIt’s photographers to either destroy or surrender to the client any outtakes from the project.

KodakIt’s restrictions continue from there, also including a ‘Moral Rights Waiver’ as part of its terms and conditions. Under this, the service’s photographers are required to waive all ‘moral rights’ to the work, which includes claiming they shot the images and in any way interfering with ‘the modification or destruction of a work.’

13 Creative Exercises for Photographers [video]

In this great video by B&H Photo & Video, photographer David Flores, along with the help of B&H’s Todd Vorenkamp, discuss 13 ways you can get your creative photography juices flowing.

In the video, David outlines the following 13 creative exercises for photographers.

13 creative exercises for photographers

1. 2 Dozen

Find a spot and stand in it. Take 24 photos while in that spot.

2. Ten of One

Take 10 photos of one small object. You may need to use close-up or macro.

3. Four Corners

Choose one subject and place it in each for corners of your frame.

4. Set artificial restrictions

Set yourself restrictions of using one of only the following: Color, black and white, photographing while lying down, shadows, only one location, one lens, over-exposing, under-exposing, filling the frame, or negative space. You may think of others you can use too.

5. Use Film

Buy a roll of film so you have to limit your max shooting number to 24 or 36.

6. 12 abstracts

Pick one single common object, take 12 photos.

7. A portable subject

Find something to carry with you and work it into your subject.

8. The Unselfie-selfie

Put yourself into the frame. Use a tripod and set up some nicely framed compositions.

9. The Mixing Bowl

Lot’s of exercises in one. Write a bunch of different exercises down onto a piece of paper and cut them into strips. Place them into a bowl/hat and pick one out. That is the exercise you focus on.

10. The Change-Up

Try a different genre of photography.

11. 9 elements

Include the 9 elements of art. Light, Shadow, line, shape, form, texture, color, size, depth. Add focus, tonality, quality of light, negative space. Take only one image per element.

12. Steps

Go somewhere you have always wanted to photograph. Pick a number of steps to take before stopping to take a photograph. Use this number over a few blocks and see what you end up photographing.

13. Two Trips

Go to a space without your camera and then go back with your camera afterward and photograph the things you had noticed.

DJI launches ‘Pro’ website for creative photographers, videographers

In September, DJI introduced a new Pro brand targeted at professional photographers and videographers. Details about the brand were slim when it was first revealed, but the company is back with more information on its newly launched DJI Pro website.

‘DJI Pro is dedicated to professionals using DJI’s advanced aerial and gimbal technologies, such as the Inspire and the Ronin series,’ the company said in a statement today.

The new DJI Pro website offers content across five categories, including product education, product information, examples of DJI’s hardware being used on film sets, information on workshops and events and the DJI Masters Program. Under the program, users are given the opportunity to learn from experts, including Tom Fitz, Hoonigan Media Machine, and Rufus Blackwell.

Ti Xie, DJI’s director of public relations had the following to say about the new website and platform:

Since the creation of the first Phantom to the Inspire and Ronin series, DJI has been dedicated to creating intuitive tools for every level of filmmaker. With the launch of the DJI Pro website, we now have a dedicated location where customers can learn about the application of our professional products and we also provide a learning-based platform for users to receive the latest information. We will continue to make more reliable, industry-leading tools for our growing customer base.

3 Critical People Skills Portrait Photographers Need

How do you ensure failure as a portrait photographer? That’s easy; treat your subjects or clients poorly. From start to finish, make the entire experience unforgettably miserable for them!

So, what does it take for an amateur or professional photographer to create a wonderful experience for their subject? Three things: generosity, empathy, and assertiveness.

Let me show you how these three qualities, combined with your photography skills, create a wonderful experience for your subjects and clients.

Treat your subjects and clients as you would your friends.

1. Begin With Generosity

When you bring a generous spirit to your work, your clients are delighted with the experience. You may be one of the few people who has treated them well. You can show your generosity with:

  • your time
  • gifts
  • yourself

When I photographed college and university students for their graduation portraits, I often gave up my lunch breaks to spend extra time with them. Maybe they were self-conscious, and I had to work extra hard to capture portraits they would love. Perhaps I wanted to take extra time to work out some creative ideas.

Don’t treat time as if it’s your you own, treat your time as if it’s theirs.

I wouldn’t normally travel so far, but this couple told me they had a really unique place for their photo session. From the highway to back roads to small trail roads, it took an hour and a half to get there. But the scenery was much different than I could have found close to home.

What does generosity look like for street photographers? Think about carrying a small printer with you so that you can print a portrait when you photograph somebody. Perhaps offer to send them one digitally.

Wedding photographers can show up a little bit early or stay a little later to capture candid photos. When I photograph weddings, couples are always so thankful that I didn’t rush to leave – especially when they are behind schedule.

You’ll take many photos as a travel photographer and discover unique places in small towns and villages. Share the love by promoting those places through Facebook, Instagram, and Pinterest.

Personality, friendship and time are among the most valuable things you can share with a person.

Over the years, some of my closest friendships began as photography clients.

Will people take advantage of your generosity? Absolutely! However, you tend to fear the worst case scenario. There aren’t very many people who take advantage of your generosity. When they do, you won’t care – because you’re generous!

For photographers in business, being generous doesn’t mean that you give everything away for free. It just means that you build generosity into your business model.

2. Empathy

Empathy is a superpower.

It is a superpower because it allows you to understand your subject or client. Empathy allows you to care for them deeply, see it their way, and serve them as a unique person instead of a fast food process.

Empathy provokes understanding and opens people up. They’ll discover something new about themselves, and you’ll discover something new about yourself.

Also, empathy means not treating people on streets as if they are mannequins on display. Ask permission to photograph people and understand when they say “no.” If you aren’t willing to spend a few minutes with them as a person, why photograph them at all?

Their ultrasound appointment revealed that they would be having a baby boy. But the doctor kept it a secret, allowing their friend to create a paint war between the couple! Once they started squirting the paint, they found out they were having a boy.

Having empathy helps you understand the exhausted parents of newborns. It helps you to understand the toddler who is tired of posing for your photos. Empathy helps you to understand the middle-aged headshot client who is self-conscious about wrinkles and their double chin. You may even have compassion toward bridezillas!

Moreover, empathy leads you to ask, “how would I want to be treated if I was getting photographed?”

When generosity is the foundation of your workflow, it is easy to be empathetic.

3. Be Assertive, But Not Bossy

Assertiveness is a critical skill for portrait photographers. Most people have no idea what to do in front of the camera (photographers included). You have to tell them!

They haven’t just come to you for a photo, they’ve come to you to get guided through the process.

You’ve tuned into your subject with empathy, so you already know they feel awkward in front of the camera. Assertiveness allows you to give your subjects direction so that they can relax and lose their self-consciousness. The first thing people used to say to me was, “tell me what to do.” They don’t ask me that anymore because I guide them from the start.

Of course, it’s possible to be overly assertive. You’ve gone too far when you’re impolite and bossy. Nobody enjoys getting photographed by a photographer who is rude.

If you’re a kind and assertive photographer, you’ll enjoy directing your subjects through your creative vision. Moreover, your subject could love you for it too.

Strength and Weakness

There is a pretty good chance that you’re stronger in one of these three and weaker in another.

Maybe you’re very empathetic but not very assertive. Alternatively, quite assertive and not very generous.

Determine where your strong points and play on those strengths. However, also observe where you are weak and work toward improving it. I can tell you from experience that even timid people can become assertive with practice.

You know how to handle a camera and work the light. When you’re equally good with people, your photography life is rewarding and fulfilling.
